Hit-and-Run of 4 Year Old Child by School Teacher

Lawrence Public School elementary teacher who was charged and plead guilty after the hit-and-run of a 4 year old child. Jaclyn Capozzi Demianiuk a mother of 3, dog owner, and school teacher was on her way to work and fled the scene after her vehicle struck a young child who was being pulled in a wagon by their mother, police said.

The child was thrown 45 feet from the point of impact which was marked by the child's bloody shoes and the crushed Barbie wagon she was being pulled in. Neighbors hearing the loud crash chased the vehicle, but failed to catch the driver. Jaclyn Demianiuk after being confronted by police turned herself in saying she thought she hit a squirrel or a dog. She later pleaded guilty to her charges.

North Reading police responded to the scene on Lakeside Boulevard on Wednesday, October 19, 2022, at about 7:40 a.m., after receiving multiple 911 calls that a young child, who was being pulled in a wagon by their parent, had been hit by a car. Jaclyn Demianiuk called the police station (Call Transcripts Here) throughout the morning inquiring about why there were police in her neighborhood, and they eventually told her they knew who she was and got her to turn herself in. Jaclyn's response to the police, while the 4-year-old was still being stabilized in the ER was, "My God, I never imagined in my life, this would happen to me."

On December 16, 2022, Demianiuk resolved the criminal charges that she faced by a tender of plea. Demianiuk pled guilty to leaving the scene of an accident after personal injury. She was placed on probation. Demianiuk’s charge of negligent operation of a motor vehicle was continued without a finding.

Rationale for Publicizing Perpetrator's Identity

Some members of the community have expressed a desire for transparency regarding the identity of the individual who recently pled guilty in the local court case. They argue that the public has a right to know the identity of those who are teaching children and living in the community.

While the individual's identity was initially withheld in accordance with the presumption of innocence, some feel that once a guilty plea was entered, continuing to conceal the identity was no longer appropriate, particularly given a perceived lack of public accountability or remorse on the part of the perpetrator outside of the courtroom. Her behavior following the guilty plea has reinforced the belief among some that she lacks remorse beyond the personal consequences she faced.

**COMPLAINT**
Now comes the Plaintiff, Jaclyn Demianiuk, and respectfully requests relief, pursuant to M.G.L. c. 30A, s. 14, from an adverse decision of the Registry of Motor Vehicles with regard to her license to operate a motor vehicle. Jaclyn Demianiuk is a 39-year-old mother of three children who works as a teacher in the Lawrence Public Schools. Ms. Demianiuk relies on her vehicle to travel to and from work as there is no public transportation between her residence and Lawrence. Ms. Demianiuk’s license to operate a motor vehicle was suspended by the Registry of Motor Vehicles despite a sentencing judge’s recommendation that her license suspension be limited to 60 days.

**PARTIES.**  
1. The Plaintiff, Jaclyn Demianiuk (hereinafter “Demianiuk”), is a natural person who resides in Andover, County of Essex, Massachusetts.  
2. The Defendant, Registry of Motor Vehicles (hereinafter “RMV”), is a duly authorized state agency in the Commonwealth of Massachusetts with the principal office located at 136 Blackstone Street, Boston, Massachusetts.**FACTS.**  
3. On or about October 19, 2022, Demianiuk was involved in an accident in North Reading, Massachusetts.  
4. As a result of the accident, Demianiuk was charged with leaving the scene of an accident after personal injury and negligent operation of a motor vehicle.  
5. At the time of the accident, Demianiuk had only one entry on her driving record for operating a motor vehicle without a license in possession that occurred in March 2012.  
6. As a further result of the accident and criminal charges, the RMV suspended her license to operate a motor vehicle indefinitely pursuant to an “immediate threat.”  
7. On December 16, 2022, Demianiuk resolved the criminal charges that she faced by a tender of plea. Demianiuk pled guilty to leaving the scene of an accident after personal injury. She was placed on probation. Demianiuk’s charge of negligent operation of a motor vehicle was continued without a finding.  
8. After a hearing in the Woburn District Court, the Court made a written recommendation that Demianiuk’s license suspension be limited to 60 days. A copy of the Court’s recommendation is attached hereto as Exhibit A.  
9. Demianiuk received notice from the RMV that her license to operate a motor vehicle in Massachusetts was suspended for one year, effective December 26, 2022. Demianiuk was further notified that the license suspension for an immediate threat remained in effect.  
10. Demianiuk requested and received a hearing with a hearing officer regarding the adverse actions taken against her license.  
11. After a hearing, the hearing officer informed Demianiuk that the immediate threat suspension remained in effect and the one-year suspension for a conviction for leaving the scene of an accident after personal injury also remained in effect.  
12. Demianiuk has not operated a motor vehicle since October 19, 2022. This has caused her great and undue hardship as there is no public transportation from where she resides to the Oliver Ames school in Lawrence where she serves as a teacher.  
13. Demianiuk appealed those decisions to the Board of Appeal docket ID 30128, Appeal ID 690170.  
14. The Board of Appeal held a hearing on April 27, 2023.  
15. On or about May 1, 2023, the Board issued its decision in docket ID 30128, Appeal ID 690170. The Board “expired the immediate threat” and affirmed the one-year suspension for leaving the scene of person injured (LSPI). A copy of the decision is attached hereto as Exhibit B.

**COUNT I.**  
16. M.G.L. c. 90, s. 24 provides, in relevant part, that regarding a conviction for leaving the scene of an accident after personal injury, “a conviction of a violation of paragraph (a) or paragraph (a1/2) of subdivision (2) of this section shall be reported forthwith by the court or magistrate to the registrar, who may, in any event, and shall unless the court or magistrate recommends otherwise, revoke immediately the license or right to operate of the person so convicted…”  
17. In this case, the court did make a thoughtful, reasoned recommendation that the license suspension for Demianiuk be limited to 60 days.  
18. The RMV refused or neglected to adopt the court’s recommendation for a limited license suspension.  
19. The RMV similarly refused or neglected to consider the ample evidence that Demianiuk had provided in support of her request for a limited license loss consistent with the recommendation of the court.  
20. By its decision, the practical effect of the decision of the RMV will be that Demianiuk’s license to operate a motor vehicle will have been suspended for over fourteen (14) months before she is eligible to have it reinstated.  
21. By its decision of May 1, 2023, in docket ID 30128, Appeal ID 690170, the Board of Appeals summarily disregarded the Court’s recommendation and affirmed the RMV decision to suspend Demianiuk’s license to operate for one year.  
22. The RMV abused its discretion and acted arbitrarily and capriciously in violation of M.G.L. c. 30A, s. 14.  
23. The decision of the RMV was unsupported by substantial evidence.**WHEREFORE**, the Plaintiff respectfully requests that this Honorable Court find in her favor and vacate the order of the Registry of Motor Vehicles to affirm the yearlong suspension of the Plaintiff’s license to operate a motor vehicle immediately. The Plaintiff further requests that the Court order the Registry of Motor Vehicles to reinstate the Plaintiff’s license to operate a motor vehicle immediately.

The Court imposed a sentence jointly agreed by the parties, and with victim input through the Commonwealth, of guilty one year of probation and completion of a driver safety course. The RMV is required to revoke the driver’s license of a person convicted under this statute for one year “unless a judge recommends otherwise.” In the submitted Tender of Plea or Admission and Waiver of Rights form, the Commonwealth recommended a statutory license loss, and the defendant recommended a 60-day license loss. At the sentencing hearing, after a recitation of the facts in support of the plea and sentence recommendation, and conveying the victim’s general support of the recommended sentence, the Commonwealth deferred to the judgment of the court on the disagreed issue of the recommended length of license suspension. The Court heard argument from counsel for the defendant for a shorter recommended length of license suspension and, after careful consideration and review of the underlying facts, review of the defendant’s lack of any prior criminal record, and minimal driving record with no responsible findings, the Court is persuaded that a further loss of driver’s license for 60 days should be recommended.
